Child custody: Why does the 'worst' parent sometimes win custody?

One of the most important ways to view your child custody disagreements is from the perspective of your child's best interests. Your child's essential needs must be met as stated in the custody plan upon which you agree or the court orders.

Children are vulnerable, and while they are growing up, parents are their protectors. Therefore, it's your job to prevent your child from suffering emotional or physical injuries. But if one parent is highly litigious and/or an aggressive fighter in court, it could help them win a child custody case. But being an aggressive litigant doesn't always translate into being a good parent.

Perhaps the aggressively litigious parent retains high-quality representation from an experienced family law and child custody attorney, and then weaves the facts of the case to make the other parent appear negligent or dangerous. Courts can make mistakes and award physically or emotionally abusive parents fully custody -- a problem you want to avoid.

A child custody fight requires much more than simply going through the motions. If your child's other parent and their legal counsel are girding for a major custody battle, they may be prepared to take no prisoners. This means that it is time to fight fire with fire.

You know that you are a good parent with whom the kids will remain safe, secure and protected. But it is vital to retain an experienced and knowledgeable child custody attorney who can defend your parental rights. While no court outcome can ever be guaranteed, laying a solid groundwork for your case can can leave you in a position for success.
